1. Introduction

Welcome to Care with Gratitude. These Terms and Conditions ("Terms") govern your access to and use of our website, mobile application, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

Important: These Terms constitute a legally binding agreement between you and Care with Gratitude. If you do not agree with these Terms, please do not use our Services.

2. Definitions

"Client" or "Participant"
An individual who registers to receive disability support services through our platform.
"Support Worker" or "Carer"
An individual who registers to provide disability support services through our platform.
"Services"
The platform, website, mobile application, and all related services provided by Care with Gratitude.
"Platform"
The Care with Gratitude website and mobile application through which Clients and Support Workers connect.
"NDIS"
National Disability Insurance Scheme.

3. Eligibility and Registration

3.1 Eligibility Requirements

To use our Services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract
  • Provide accurate and complete registration information
  • Comply with all applicable laws and regulations

3.2 Account Registration

To access certain features of our Services, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access
  • Notify us immediately of any unauthorized use of your account

3.3 Support Worker Verification

All Support Workers must:

  • Provide valid identification documents
  • Undergo background checks as required by law
  • Provide proof of relevant qualifications and certifications
  • Maintain valid Working with Children Checks and police checks
  • Comply with NDIS requirements and standards

4. Service Description

4.1 Platform Services

Care with Gratitude provides a platform that connects Clients with Support Workers. We are not:

  • An employer of Support Workers
  • A direct provider of disability support services
  • Responsible for the quality of services provided by Support Workers

4.2 Role of Care with Gratitude

Our role is limited to:

  • Providing the platform for connection
  • Facilitating payment processing
  • Verifying Support Worker credentials
  • Providing customer support

Important: Care with Gratitude does not guarantee the suitability, reliability, or quality of any Support Worker. Clients are responsible for selecting and supervising their Support Workers.

5. Booking and Payment

5.1 Booking Process

Bookings are made through our platform and are subject to:

  • Support Worker availability
  • Client requirements and preferences
  • Service agreement between Client and Support Worker

5.2 Payment Terms

All payments are processed through our secure payment system:

  • Clients agree to pay for services booked through the platform
  • Rates are displayed during the booking process
  • All fees are inclusive of GST where applicable
  • Payment is processed upon completion of services

5.3 Cancellation Policy

Cancellation terms vary based on notice period:

  • More than 24 hours notice: No cancellation fee
  • Less than 24 hours notice: 50% of booking fee
  • No-show: Full booking fee applies

6. User Responsibilities

6.1 Client Responsibilities

Clients agree to:

  • Provide accurate information about support needs
  • Treat Support Workers with respect and dignity
  • Provide a safe working environment
  • Pay for services rendered in accordance with these Terms
  • Comply with NDIS requirements and guidelines

6.2 Support Worker Responsibilities

Support Workers agree to:

  • Provide services with professionalism and care
  • Maintain required certifications and clearances
  • Report incidents and concerns to Care with Gratitude
  • Comply with all NDIS standards and regulations
  • Maintain appropriate insurance coverage

7. NDIS Compliance

7.1 NDIS Requirements

All Services must comply with NDIS requirements including:

  • NDIS Code of Conduct
  • NDIS Practice Standards
  • NDIS Pricing Arrangements and Price Limits
  • Incident management and reporting requirements

7.2 Service Agreements

Separate service agreements may be required between Clients and Support Workers to comply with NDIS requirements. These agreements are the responsibility of the parties involved.

8. Intellectual Property

All intellectual property rights in the Services, including trademarks, logos, text, graphics, and software, are owned by or licensed to Care with Gratitude. You may not use, reproduce, or distribute any content from our Services without our prior written permission.

9. Limitation of Liability

Important Limitation: To the maximum extent permitted by law, Care with Gratitude shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.

Our total liability for any claim arising under these Terms shall not exceed the amount paid by you for Services in the six months preceding the claim.

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting us or through your account settings.

10.2 Termination by Us

We may suspend or terminate your access to the Services if:

  • You violate these Terms
  • We suspect fraudulent or illegal activity
  • Required by law or regulatory authorities
  • For any other reason at our sole discretion

11. Dispute Resolution

11.1 Informal Resolution

We encourage you to contact us first to resolve any disputes informally.

11.2 Formal Resolution

If informal resolution fails, disputes shall be resolved through mediation or arbitration in accordance with Australian law.

11.3 Governing Law

These Terms are governed by the laws of the Australian Capital Territory, Australia.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.

Notice: These Terms do not create any agency, partnership, joint venture, or employment relationship between you and Care with Gratitude. These Terms constitute the entire agreement between you and Care with Gratitude regarding the Services.
